1. Agreement and eligibility
This End User License Agreement is between Build Daily, LLC. ("Build Daily") and the person using Build Daily software, including its web and mobile applications, desktop utilities, Outlook add-in, APIs, and related components. You may use the software only through an active account authorized by a subscribing organization or another valid Build Daily entitlement. By installing, accessing, or using the software, you accept this agreement and the Terms of Service.
2. License
Build Daily grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the software for legitimate business activity authorized by your organization during the applicable subscription or entitlement period. The software is licensed, not sold.
3. Accounts and permissions
You must protect your credentials and use only accounts, organizations, mailboxes, files, and records you are authorized to access. Product capabilities may be limited by your organization's subscription, administrator settings, role, and record-level permissions. An add-in or client installation does not grant additional Build Daily authority.
4. Restrictions
You may not copy or distribute the software except as expressly permitted; rent, lease, sell, sublicense, or provide it as a service to unauthorized parties; bypass access, security, licensing, or usage controls; reverse engineer or derive source code except where applicable law does not permit that restriction; use undocumented automated access; introduce malicious code; or use the software unlawfully or outside your organization's authorization.
5. Customer data and connected services
Customer data remains subject to the customer's agreement with Build Daily. When you direct an integration such as Build Daily for Outlook to process a message, meeting, or attachment, you represent that you are authorized to provide that content and perform the selected workflow action. Personal information is handled under the Privacy Policy.
6. Third-party platforms
Some functionality depends on third-party platforms such as Microsoft 365, application stores, hosting providers, payment providers, or device operating systems. Their separate terms apply to those services. Build Daily does not control their availability, account policies, or client behavior.
7. Updates and availability
Build Daily may update, replace, repair, or discontinue software components to maintain security, compatibility, and product operation. Updates may be required for continued use. Features can vary by platform, client version, organization configuration, subscription, and permissions.
8. Ownership and feedback
Build Daily, LLC. and its licensors retain all rights in the software, product design, documentation, trademarks, and related technology. No ownership transfers under this agreement. If you provide feedback, Build Daily may use it without restriction or compensation, provided that doing so does not transfer ownership of customer data.
9. Suspension and termination
This license ends when your authorization, account, subscription, or applicable entitlement ends. Build Daily or the subscribing organization may suspend access to protect security, comply with law, address misuse, or enforce applicable agreements. When the license ends, you must stop using and, where applicable, uninstall the software.
10. Disclaimers and liability
The software is provided "as is" and "as available." To the maximum extent permitted by law, Build Daily disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Liability is limited as stated in the Terms of Service.
11. Governing law and contact
This agreement is governed by New Jersey law, excluding conflict-of-law rules, unless applicable law requires otherwise.
